Apple is involved in a troublesome lawsuit again

The incident happened in 2020 when Apple’s AirPods headset punctured the eardrum of a 12-year-old boy, the litigation process lasted for 2 years and has not ended.

According to a lawsuit filed by Law Firm Paranjpe Mahadass Ruemke, the boy’s parents explained that he was watching Netflix on an iPhone connected to the AirPods Pro. The volume of the AirPods is said to be low, but the Amber Alerts made a high-pitched noise without warning, causing the boy’s eardrums to be severely damaged. It is known that the Amber alert is the type of warning commonly used by US police to notify the public about missing children.

When an alert is received, iPhone vibrates and makes a loud sound. In this incident, the sound level of Amber Alert was so loud that the boy suffered from dizziness, lightheadedness, ringing in his ears and nausea. Later, the boy’s right ear was diagnosed with permanent hearing loss, forcing him to use a hearing aid.

According to Street Insider, this family is suing Apple as well as its manufacturing partner Luxshare. The allegation against the companies is “negligence in not properly designing and testing the device, failing to warn users that headphones could be susceptible to rapid and unexpected volume increases, and failing to produce properly export AirPods”.

The brand also doesn’t provide instructions for users to limit the alert volume. “If Apple had been more careful, the boy could have had a normal life,” the family said.

 It is known that both Apple and Luxshare were aware of the design and manufacturing defects of the AirPods. There have been 1,538 complaints from other AirPods Pro users since April 12, 2019 about the volume of AirPods often increasing suddenly. However, to date, the company has not made any comment or response on the incident.
